Terms of Service

These terms govern your use of SpinWin, a gamified email-capture app for OpoShop stores, operated by Found. By installing or using SpinWin, you agree to them.

The service

SpinWin lets an OpoShop merchant show a customizable popup game (spin-to-win, scratch card, or mystery offer) that captures shopper emails and awards prizes. Prizes that are a percentage or fixed amount off are enforced by creating real, single-use discount codes through OpoShop's own discount engine; other prize types reveal a code the merchant supplies, or a message the merchant fulfils.

Your responsibilities

• You are responsible for the prizes and discounts you configure, and for honoring them. SpinWin creates the codes you set up; the resulting margin impact is yours.
• You are the data controller for the emails you collect. You must have a lawful basis to collect and market to them, provide required disclosures, honor unsubscribe/deletion requests, and comply with applicable law (e.g. GDPR, CAN-SPAM, CCPA).
• You must not use SpinWin for unlawful, deceptive, or abusive purposes, or to run a promotion that violates applicable sweepstakes/contest law in your jurisdiction.

Fairness of the game

The winning outcome of each play is determined on SpinWin's servers using the odds weights you configure. The on-screen animation is cosmetic. SpinWin does not guarantee any particular win rate beyond the weights you set, and you are responsible for setting prize values and odds that are sustainable for your business.

Availability

We work to keep SpinWin available and reliable, but it is provided "as is" without warranties of any kind. The storefront widget is designed to fail safe — if anything goes wrong it simply shows nothing rather than interfering with your store.

Limitation of liability

To the maximum extent permitted by law, Found is not liable for indirect, incidental, or consequential damages, or for lost profits or revenue, arising from your use of SpinWin. SpinWin depends on the OpoShop platform and its APIs; we are not responsible for changes, outages, or limitations of that platform.

Termination

You may stop using SpinWin and uninstall it at any time. We may suspend or terminate access for a violation of these terms or to comply with law. On uninstall, your store is deactivated; you may request deletion of your data.

Changes

We may update these terms; material changes will be reflected by the "last updated" date above.
